Terms and Conditions of Trade

All products ("Products") purchased by the customer ("the Customer") from quicksellsigns4cars.com.au ("Quicksell") and any contract or arrangement in respect thereof shall incorporate, be governed by, and be subject to the following terms and conditions ("Terms") unless otherwise agreed in writing.

1. Quotations and Invoices

1.1 Currency for all quotations and invoices is in Australian dollars ($AUD) unless otherwise stated.
1.2 Unless otherwise advised by Quicksell in writing:
1.2.1 Prices include GST and other applicable taxes.
1.3 Quotations and pricing are subject to change without notice.
1.4 A quotation is an offer by Quicksell to sell the Products and is subject to acceptance by the Customer placing an order on the Quicksell website.
No contract exists between Quicksell and the Customer until acceptance of the quotation by the Customer pursuant to this clause.
1.5 Quicksell reserves the right to supply the Products with minor necessary modifications and specification at Quicksell's discretion.
1.6 Quicksell reserve the right to withdraw any product advertised without notice.
1. 7 Quicksell reserves the right to make changes and corrections in prices and Products without notice.

2. Payment

2.1 Full payment is immediately payable by the Customer to
Quicksell when placing an order.
2.2 All payments must be made by credit card.

3. Delivery

3.1 All Products will be delivered by regular post and charged accordingly.
3.2 Delivery dates indicated by Quicksell on acceptance of a Customer's order are approximate only and do not constitute a guarantee of delivery or delivery by such date.
3.3 The risk in the goods shall pass to the Customer upon delivery to a postage or courier company.

4. Delays

4.1 Quicksell will not be held liable for any costs or delays suffered by reason of, but not limited to, the inability of Quicksell to obtain supplies from its usual sources or any event for which Quicksell could not reasonably have exercised control. The contract will be deemed to be suspended with liberty to Quicksell at any time to cancel the contract or any unfulfilled part or to renew the contract upon the cessation of the cause preventing performance.

5. Refunds and returns

5.1 Goods supplied in accordance with the Customer's order cannot be returned for credit or refund subject to clause 8 of these Terms.

6. Indemnity

6.1 The Customer indemnifies Quicksell in respect of any claim, action, damage, loss, liability, cost, charge, expense, outgoing or payment suffered or incurred by Quicksell (including, but not limited to, economic loss and all legal costs and disbursements on a full indemnity basis) caused by the Customer's use of the Quicksell website and/or any willful, illegal or negligent act or omission by the Customer.

7. Liability

7.1 Quicksell shall not be liable for any delay or failure to
perform it’s obligations if such failure was caused by any event for which Quicksell could not reasonably have exercised control.

8. Warranty

8.1 All warranties, conditions and representations whether express or implied other than express warranty stated by Quicksell in writing are expressly excluded except in circumstances whereby Quicksell is by law unable to exclude or limit liability. To the fullest extent permitted by law, Quicksell shall not be liable to the Customer for loss of profit or other economic loss, indirect, special, consequential, general or similar damages arising under any order or for negligence by Quicksell or the Customer or for any claim made against the Customer by any other party, even if Quicksell has been advised of the possibility of such claim.

9. Intellectual property

9.1 Quicksell does not grant any licence or right in, all or any Part of its intellectual property in the content 0 f this website or on any product sold to the Customer from this website.

10. Amendments

10.1 Quicksell may amend these Terms by posting a notice on Quicksell's public website. Products purchased by the Customer from Quicksell after the posting of such notices to amend these Terms are construed as, and is evidence of the Customer's acceptance of the amended Terms.

11. Assignment

11.1 Quicksell may assign its rights under these Terms in its full discretion without the consent of the Customer.
11.2 The Customer may not assign any of its rights under
these Terms without the prior written consent of Quicksell.

12. Service of Notice

12.1 All notices must be in writing and be given by:
12.1.1 Personal service on the other party; or
12.1.2 Prepaid post to the other party; or
12.1.3 Facsimile transmission to the other party.
12.2 Service is effected 2 days after posting if the notice IS posted.

13. General

13.1 Any time or other indulgences that Quicksell may grant to the Customer shall not affect the rights of Quicksell except to the extent which Quicksell expressly waives the same in writing and no waiver in respect of any breach of the Customer's part of any stipulation on the Customer shall affect the rights of Quicksell in respect of any breach.
13.2 Any condition contained in the Customer's order or other documentation which may be contrary to or differ from these conditions shall to the extent of any inconsistency be null and void.
13.3 The headings of the clause of the Terms are intended for convenience only and shall in no way affect the construction thereof.
13.4 In the event that any provision of these Terms is held invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
13. 5 These Terms are governed by, and must be construed in accordance with, the laws of the State of Victoria.
